The case broke open when, due to relentless discovery, Atlas revealed the identity of an employee who admitted during his deposition that he failed to ensure the compressed air tank was bolted securely into concrete before turning the air compressor system on. Atlas had previously filed a Motion for Summary Judgment with no mention of this witness or the critical documents finally discovered by Casey Gerry. The judge ruled in favor of Casey Gerry on the Motion for Summary Judgment following extensive briefing and argument.
An employee from Buds who was also present likewise failed to make sure the tank was secure and bolted to the ground before activating the system moments before the injury.
Casey Gerry secured a $6 million settlement for our client that includes compensation for lifetime medical care and lost earning capacity.
