CaseyGerry Files Class Action Suit in US Fertility Data Breach

CaseyGerry has filed a Class Action suit on behalf of those impacted by the US Fertility LLC data breach which exposed highly personal and sensitive information of patients across the country seeking medical help for infertility.

The Class Action, which was filed in the state of Maryland, accuses the defendant, US Fertility LLC of Negligence, Breach of Implied Contract, Unjust Enrichment and the Nevada Deceptive Trade Practices Act.

US Fertility LLC is one of the largest networks of fertility clinics in the United States if not the largest, providing support services in business, administration, and clinical support. The number of patients affected remains unknown, however, with the reach of the network, the impact will most likely be widespread.

The breach was a result of a ransomware attack on the company’s servers that occurred in September of 2020. In addition to inadequate data protection of patients’ data, the company failed to report the incident to those potentially affected until two months after the incident.

Their failure to do so further exposed patients’ highly sensitive information to identity theft and more. Compromised data included name, address, date of birth, social security numbers, driver license number, passport number, MPI number, Health Insurance information, diagnoses, and credit/debit card information.
