CaseyGerry chosen for steering committee
CaseyGerry has been appointed by U.S. District Court Judge Anita Brody to serve on the Plaintiffs Steering Committee which is overseeing national MDL litigation against the National Football League (NFL). The litigation alleges that multiple concussions can lead to long-term brain injuries. CaseyGerry is one of only nine law firms in the nation – and the only one in San Diego – serving on the leadership committee.
Firm partner Frederick Schenk will represent the firm on the Steering Committee, which is charged with overseeing pre-trial discovery; coordinating, submitting and arguing pre-trial motions; deposing and examining witnesses; introducing evidence at hearings; and negotiating stipulations and settlements with defendants. In the last several months, GM has recalled more than 3.1 million vehicles – with GM chief executive, Mary Barra recently acknowledging that the company fell short in catching faulty ignition switches. CEO admits “terrible things happened”
While GM said that 12 people have died in accidents related to the ignition switch problem Story Behind Recall, other data points to many more deaths. According to a review by Friedman Research, federal crash data found that 303 drivers and front-seat passengers died in accidents in which air bags did not inflate in the two models – the 2005-2007 Chevrolet Cobalt and the 2003-2007 Saturn Ion.
The review was commissioned by the Center for Auto Safety, a consumer group which maintains that GM and federal auto safety regulators failed to adequately respond to/review complaints about faulty ignition switches.
Watchdog group identifies deaths related to undeployed air-bags
The Issue
Specifically, the most serious problem lies in a faulty ignition switch that can turn off while the vehicle is driving, causing it to suddenly stall. The problem is attributed to heavy keyrings which can accidentally pull the key into the “off” position. If the key ring is jostled out of place, it can trigger an immediate loss of power — in which the driver loses function of power steering and the airbags are disabled, potentially resulting in serious accidents and injuries.
Which Cars Have Been Recalled?
The initial ignition switch recall on Feb. 13 covered the Chevrolet Cobalt from model years 2005 to 2007 and Pontiac G5 from model year 2007. Two weeks later it was widened to include the Saturn Ion from model years 2003 to 2007, the Chevrolet HHR, Pontiac Solstice and Saturn Sky from model years 2006 to 2007. Other models affected are the 2005-06 Pontiac Pursuit sold in Canada and the 2007 Opel GT sold in Europe. The March recalls are related to a faulty wiring harness of seat mounted air bags and include 1.18 million Buick Enclave and GMC Acadia from model years 2008 to 2013; Chevrolet Traverse from model years 2009 to 2013 and Saturn Outlook from model years 2008 to 2010.
