“Dear David: It was certainly my pleasure to meet you on October 13 and again I want to congratulate you and your team for a remarkable result on the Michelson/Tesla case. Sadly, our good friend and colleague Doug Swope could not join our celebration albeit his presence was certainly felt. It has taken me some time to process exactly what happened in this case since it first came to my office to the time your team secured an incredible $3M settlement. Securing the thumb drive from the Tesla with video evidence that Michelson had a green light at the time of the accident was, at first, my number one priority. Without that evidence and without witnesses, there would have been no case. After securing said evidence and contacting the various insurance companies involved, my second priority was to determine exactly what injuries Michelson had sustained so that the case could be properly evaluated. I contacted Doug to discuss the injuries and get his take. As you probably know, Doug had recently secured a $600K+ jury verdict in Riverside County, a very difficult plaintiff’s venue, on a similar TBI case. As usual, Doug provided some valuable insight which I followed until I realized that I was up against a Fortune 500 company with a large policy and a Los Angeles defense law firm that could best be described as the proverbial 800lbs gorilla. I needed to associate experienced trial counsel and chose Doug because of his recent TBI case. Not long after Doug filed the lawsuit, he became ill and, given his diagnosis, I knew that his
prognosis was not good and he needed to concentrate all his efforts on his recovery and I asked him to pass the baton to your firm.
The very first Zoom meeting with Schenk and his team was, quite simply, impressive. Schenk’s knowledge of TBI injuries and the roadmap he quickly drew then and there on how the case should proceed and which experts to hire was just.. incredible.
As the case developed, Michelson would call me to get my take on the legal process that was unfolding. It was through these phone calls with Michelson that I was able to get a sense of the trajectory and scope your team was undertaking.
Simply put, what I witnessed was a total and complete commitment to the case by your team. You spared no expense in hiring the best expert witnesses in the TBI field, you toyed with opposing counsel making different 998 offers and, during this course, you subpoenaed all witnesses for trial even before mediation..in short, you opened the gates of Hell and dared opposing counsel to walk through! From a legal and tactical standpoint, what your team did should be part of a textbook curriculum on how to prepare a case for trial. It was masterful and it was impressive.
We have done business in the past and, rest assured David that we will do business in the future. Your team picked up the ball and ran with it in impressive fashion.. Mr. Michelson and I are obviously pleased, and I know that Doug is up there smiling and nodding in approval.”
