Information on Elder Sexual Abuse Law and How to Protect Loved Ones
California civil law protects the elderly and others against sexual battery, abuse and harassment. Sexual battery refers to the act of intentionally harming another person through sexually offensive contact. Sexual harassment includes unwelcome, pervasive or severe sexual advances, solicitations, sexual requests, demands for the victim’s sexual compliance, and other conduct.

Recognizing Elder Abuse
It may be very difficult to spot when elder sexual abuse is happening, especially if your loved one suffers from dementia or related conditions. Some possible physical indicators of elder abuse include bruises, cuts or broken bones as well as painful or fearful reactions when touched. Pay close attention to comments and remarks related to persons “being mean” or “hurting” your loved one, or comments about your loved one having a boyfriend or girlfriend.
Any noticeable behavioral changes may also suggest elder rape or abuse is happening. Possible behavioral indicators include withdrawal, fear, anxiety, hesitation to talk openly, and other changes. If a loved one is in danger, contact law enforcement immediately and report the abuse to your local Adult Protective Services (APS) office.
