In a win for consumers, the California Supreme Court has denied Amazon’s Petition for Review of the landmark decision in Bolger v. Amazon.com, and Amazon’s request to depublish the opinion. That leaves the decision as the only published appellate opinion in the country holding Amazon liable for defective products sold on its website.

Bolger sustained third-degree burns when a laptop replacement battery she purchased on Amazon’s Marketplace exploded while the laptop was in use. A lower court had ruled in favor of Amazon, however, the appeal reversed the decision, ruling that Amazon can be held strictly liable for defective products sold on their platform.
