Young Boy Hit by Crashing Airplane on Carlsbad Beach on July 4th

On July 4, 2015, a 12-year-old boy was seriously injured when a single-engine Piper PA 18 Super Cub towing an advertising banner crashed on a crowded Carlsbad beach. Casey Gerry represented his family in litigating and ultimately negotiating a confidential settlement in the case, which involved the pilot’s failure to maintain a 500-foot distance from innocent people on the ground.

Multiple news reports noted “the plane’s engine failed as it flew over the water and lost the banner it was towing.” CaseyGerry concluded the aircraft’s fuel tank ran dry – and the pilot did not have time to switch to the other tank which contained fuel because the aircraft was low when its engine quit. Tragically, when the aircraft crash landed and flipped over in the shallow surf where the boy was playing, it struck him in the head.
