Settlement Reached for Injured Cyclist

“As a result of negligence and carelessness on the part of the driver, our client was seriously injured and out of work for months.”

Attorneys for an injured San Diego cyclist reached a $1.9 million settlement for personal injury and damages in an out-of-court agreement with defendant Newport Beach Sales and Leasing – operators of an airport shuttle service for Budget Rent-A-Car. The cyclist was severely injured when he was struck by a shuttle van near the San Diego Airport.

CaseyGerry partners Frederick SchenkThomas D. Penfield and Robert J. Francavilla each handled different aspects of this complex case. According to Penfield, the client was riding his bike westbound on Laurel St. near Harbor Dr., when he was struck by the shuttle van. “As a result of negligence and carelessness on the part of the driver, our client was seriously injured and out of work for months – incurring significant expenses for his medical care and hospitalization,” Penfield said.

Francavilla was able to establish that the driver was negligent and settled the matter the night before trial was to start.

Schenk noted that the settlement funds will cover medical care and expenses as well as compensate the plaintiff for the effect the incident will have on his quality of life.

Verdict: $1.9 million
