Cases on Behalf of People Suffering from Lung Disease

In 1996, firm partner Frederick Schenk won the largest verdict ever awarded in asbestos litigation in San Diego County at that time. In a lawsuit against Owens Corning Fiberglass, Fred obtained a $2.4 million verdict in economic and punitive damages. His client had developed terminal mesothelioma after exposure to asbestos insulation while serving aboard the U.S.S. Constellation. Owens Corning was aware of the product’s hazard and failed to remove it from the market or warn of the dangers.

Cases Against Big Tobacco

Governor Gray Davis selected CaseyGerry as one of the firms to pursue a private attorney general action against Big Tobacco. The case was included in the national settlement of $206 billion by the tobacco industry, with California receiving $25.2 billion. CaseyGerry also served as co-counsel in representing Californians in a class action against the tobacco companies for unfair business practices.

Firm partner David S. Casey, Jr., who represented the family of deceased baseball Hall of Famer Tony Gwynn, reached a confidential settlement with the U.S. Smokeless Tobacco Company, ending a lawsuit that sought to hold the company responsible for “killing a baseball legend.” Gwynn died of salivary gland cancer following a lifetime addiction to smokeless tobacco.
